Welcome to Resident of the Sky. These terms and conditions outline the rules and guidelines for all bookings made through our agency. By confirming your booking, you agree to the following terms and conditions:
1. General Terms
1.1. Contract Agreement
A booking is confirmed once a deposit or full payment has been received. This constitutes a binding agreement between you (the client) and Resident of the Sky.
1.2. Accuracy of Information
You are responsible for providing accurate personal and travel information at the time of booking. Any errors may result in additional fees or complications, for which you will be responsible.
1.3. Payment Terms
A deposit (or full payment) is required at the time of booking to secure your reservation. The amount and due date will be specified in your quote. The balance must be paid no later than 30 days prior to departure. If full payment is not received by the due date, we reserve the right to cancel your booking and
retain any deposit paid.
1.4. Travel Documents
Passports, visas, and other travel documents are your responsibility. Ensure these are valid for the duration of your trip and meet the requirements of your destination.
2. Booking Modifications
2.1. Changes by the Client
• Requests to amend confirmed bookings (e.g., date changes, name changes) will incur an administration fee of R500 per change, plus any additional costs charged by suppliers. • Changes are subject to availability and cannot be guaranteed.
2.2. Changes by the Agency
• While we will make every effort to operate all bookings as confirmed, we reserve the right to cancel or amend arrangements due to circumstances beyond our control (including but not limited to force majeure events, supplier failures, government regulations, or safety/ weather considerations). • If we must cancel your booking, you will be offered one of the following options: • An alternative booking of comparable standard, if available. • A credit note valid for 12 months. • A full refund of payments made to us for the cancelled portion, excluding services already rendered.
3. Cancellations
If you cancel your booking for any reason, the following cancellation fees will apply: • More than 60 days before departure: 10% of the total booking cost. • 31–60 days before departure: 25% of the total booking cost. • 15–30 days before departure: 50% of the total booking cost. • 14 days or less before departure / No-show: 100% of the total booking cost. Important: • Cancellations must be received in writing via email to be effective. • Refunds will be processed within 21 working days, less any bank charges and non-refundable supplier fees.
4. Pricing and Inclusions
4.1. Package Pricing
Prices are quoted in Rands and are subject to availability and change without notice until confirmed.
4.2. What’s Included
Packages include the services explicitly stated in your itinerary (e.g., flights, accommodation, transfers).
4.3. What’s Not Included
Items such as visas, travel insurance, personal expenses, and gratuities are not included unless specified.
5. Travel Insurance
• Comprehensive travel insurance covering cancellation, curtailment, medical expenses, personal liability, and loss of luggage is strongly recommended. • We will not be liable for any costs, damages, or losses for which travel insurance could have provided cover. ⸻
6. Liability
6.1. Third-Party Services
We act as an agent for third-party providers (e.g., airlines, hotels, tour operators) and are not liable for their actions or service quality.
6.2. Force Majeure
We are not responsible for cancellations, delays, or losses caused by events beyond our control, such as natural disasters, strikes, or government actions.
7. Special Requests
Special requests (e.g., dietary needs, room preferences) must be communicated at the time of booking. While we will do our best to accommodate, these cannot be guaranteed.
8. Privacy Policy
Personal information provided for bookings will be used in accordance with our [Privacy Policy] and shared only as necessary to fulfill your travel arrangements.
9. Governing Law
These terms and conditions are governed by the laws of South Africa. Any disputes shall be resolved in accordance with South African law.
